§1 General Information

  2. The seller operates on a flat-rate basis and is exempt from VAT. All prices in the store are final gross amounts (VAT 0%).
  3. These regulations set out the rules for placing orders, concluding sales contracts, delivery, payment, complaints and the right of withdrawal by the Consumer.

§2 Definitions

  • Store – online store available at www.tkart.eu.
  • Seller – Tomasz Kotarski, doing business as Jurassic Lures.
  • Customer – any natural person, legal entity or organizational unit placing an order.
  • Consumer – an individual making a purchase not directly related to business.
  • Product/Commodity – movable items offered in the store, mainly handicrafts: e.g. fishing lures.
  • Sales contract – a contract concluded at a distance between the Seller and the Customer.

§3 Placing orders

  1. Orders can be placed 24/7 via www.tkart.eu.
  2. The customer selects a product, adds it to the cart and fills out the order form.
  3. Placing an order constitutes the conclusion of a sales contract and implies acceptance of these terms and conditions.
  4. The customer is obliged to provide true data – their absence or inaccuracy may prevent the processing of the order.

§4 Pricing and payment

  1. All prices in the store are expressed in Polish zloty (PLN) and include 0% VAT (sales without VAT).
  2. Available payment methods:

§5 Delivery

  1. Orders are processed through:
    • InPost Parcel Machines 24/7
    • DPD Courier
    • UPS Courier
  2. The cost of delivery is displayed in the shopping cart when placing an order. Free shipping is possible for larger orders (according to current promotions).
  3. Order processing time is usually 2 to 5 business days after the payment is credited.
  4. Products are carefully packaged to ensure safe transportation – this is especially true for delicate fishing lures.

§6 Withdrawal from the contract

  1. The consumer has the right to withdraw from a distance contract within 14 days of receiving the goods – without giving a reason.
  2. In order to exercise the right of withdrawal, you must send the appropriate statement by e-mail to the following address: tom@tkart.eu.
  3. The consumer is obliged to return the goods in unaltered condition, no later than 14 days from the date of the statement.
  4. Refunds will be made within 14 days of receiving the returned product.

Exclusion of the right of withdrawal:

In accordance with Article 38 of the Law on Consumer Rights, the right of withdrawal does not apply to:

  • custom-made products,
  • Non-prefabricated goods, prepared according to customer specifications,
  • products with the characteristics of unique handicrafts.

Jurassic Lures products – being handmade and often individually finished – are not returnable unless they have manufacturing defects.

§7 Complaints

  1. In case of a defect in the goods, the customer has the right to make a complaint.
  2. Complaints should be submitted by email to tom@tkart.eu along with a description of the defect and a photo.
  3. The seller will respond to the complaint within 14 days.
  4. If the complaint is accepted, the customer will receive:
    • repaired or new product,
    • Or return of funds – as agreed.

§8. personal data protection

  1. The administrator of the Customers’ personal data is Tomasz Kotarski, doing business under the name Jurassic Lures.
  2. Data is processed in accordance with the RODO Regulation and applicable Polish law.
  3. Details are described in a separate Privacy Policy available on the store’s website.

§9 Final provisions

  1. The store reserves the right to change the regulations – changes do not affect the rights acquired by customers.
  2. In matters not covered by the regulations, the provisions of the Civil Code and the Law on Consumer Rights shall apply.
